1. Service
Napexa provides product-resolution, comparison and routing services, and an exchange where users list goods and services to one another. We are not the seller, the merchant of record or the payment processor, on either side. For catalogue results the merchant remains responsible for checkout, payment, fulfilment, returns and statutory seller obligations. For a sale between users, section 5 applies.
2. Data use and separate consent
We collect account identity and API usage needed to provide, secure and measure the service. Aggregate, non-personal derivatives of API demand may be sold as data products. Account-attributed usage is personal data and is included in a data product only where the account holder has given separate, optional opt-in consent. Refusing or withdrawing that consent does not change the service, quotas, API key or API results.
Optional data-products consent: I agree that usage linked to my account may be included in account-attributed demand analysis. We may combine usage from multiple accounts and sell only aggregated, non-personal derivatives above a k-anonymity threshold to data customers. This consent is optional, does not affect account or API access, and may be withdrawn at any time.
Service emails needed to operate an account are sent under the contract with the account holder, not under consent.
3. Acceptable use
Do not transmit personal data about another person in a query. Do not attempt to extract a whole catalogue, remove coverage or price-completeness disclosures, or generate a click without a genuine user action.
4. Pass-through warranty
The key holder warrants that it will not transmit personal data of any third party in queries, and that it holds the necessary rights and lawful basis for any data it does transmit.
5. Sales between users
Napexa is an exchange. When you buy from another user, the contract of sale is between you and that seller; Napexa is not a party to it, is not the seller, and is not the merchant of record. We provide the listing, the introduction and the payment route, and we charge the seller a commission for that service.
A seller states whether they are selling privately or as a trader, and that answer decides which consumer rights the buyer has against them. We ask it, record it and show it. We do not verify it, and it is the seller's statement rather than ours.
Payment is taken by our payment provider, not by us, and no card details reach Napexa. Refunds, returns, delivery and the condition of goods are matters between buyer and seller. Where a dispute is raised through the payment provider, its process governs the outcome. We will suspend a listing or an account where our rules require it, but we do not adjudicate a sale.
Ratings are left by the parties to a completed order and are their statements, not ours.
6. Retention and withdrawal
Account and consent records are retained while an account is open and for 7 years after it closes where needed to establish the contract or consent history. API usage and query fingerprints are retained for 24 months. A data-products or marketing consent can be withdrawn at any time through the account consent endpoint; withdrawal is recorded as a new history entry and does not affect service access.
Separate choices at signup
Accepting these terms is required to form the service contract. The optional data-products choice is separate, starts unticked, is not required for an account or API key, and can be withdrawn through the account consent endpoint at any time.
